    I have had one years experience at getting rentals in my other apt at Puerta Marina (about 300 mt from SP, front line).

    What I am learning is that the most important thing to support rentals is to have a good Syndiq for the complex that is run by the owners for the owners and not run to make a profit for the Syndiq personel.

    Ideally the syndiq would have an office in the building and a lot of rental enquiries will come this way. More than you will get through rental agents.

    We need to make sure that we create a Syndic for SP that is run by the owners for the owners and this will require effort, attention and the brief services of a moroccan lawyer. Otherwise we will end up with a developer controlled Syndic which exist primarily to take money away from us and provide an earner for the developer. To give you an example at Puerta marina we have had the local 'site administrator' disconnecting peoples satellite connections and then charging them money to reconnect it when they have tenants in. In my opinion if we dont take control of the situation ourselves it could be at worst a serious problem for the future and at best a continual drain on our finances.

    Hi Paul

    I have flats at Mirador Golf and responded to your invitation to join your group ages ago. It was very interesting and instructive to follow your travails, and two or three people buying have stayed at my flats, I hope I was able to help others with tips on travel etc. Now you are all set up and will stay in each other's flats if necessary and give each other advice - I rather miss the emails and following what went on and the names became familliar!


    I am having very similar problems now with a flat I am buying at Kariat Smir (opposite Kabila Marina). Your problems have made me decide just to give in and buy the flat ( was given one in the wrong place), Moroccan law is not for the faint hearted, I have learned from you, though you succeeded in the end.

    Can I pass on one last piece of advice? It is essential to participate in the choosing of the syndique. It is difficult to know what is happening with the MG one, but the Moroccan Vice- President refuses to communicate with owners or foreign syndique members- the British and French ones are only notified the day before meetings, and no questions are answered, receipts given for money or accounts available for this or last year. The Jawhara Smir thread on Eye on Worldwide gives you an idea of what is happenning to them: it appears they will run out of money before the summer. Please do pass on this warning.

  3. Bess also responded to my question on timing and mechanism for setting up the syndique as follows:

    The first year after a development the complex is run by the builder, who should do all ths snagging etc, and ask for the community fees. After that there has to be a yearly meeting of all owners, who elect a syndique to run the complex on their behalf, the president or vice president seems to do the executive stuff.

    The problem is, that for the meeting to be quorate, there must be a minimum of 50% of the owners present, which is fine in a normal residential block, but not it seems for holyday flat blocks. Without the 50% there is no legal election, there must be another meeting held, I think it is within 2 weeks. At that meeting however few people are present, those elected are
    the syndique for a year.

    Last year , a lot of MG non Moroccan owners as well as Moroccans turned up for the first meeting- I had queried the problem before and been assured all was OK. There was a lot of shouting, Moroccan owners said that the meeting was illegal because of a lack of owners, they challenged the power-of-attorney of representatives of owners. I thought we could discuss things anyway, so the future syndique would know people's views, but all ended in disarray.

    Not surprisingly, two weeks later there was a meeting with very few present, those non residents who had been there two weeks earlier being unable to return. A syndique was elected, but since then very little more is known. Non morocco residents who are members of the syndique have been ignored. There are lots of rumours - ie that the vice president is being paid by comunity fees to run the complex, instead of appointing a firm to do so, he has refused access to the site to service firms, to help his brother in law who runs one. Fees have been asked for with threats of water being cut off for non payment, but no reciepts are given, which does not help when making tax returns.

    There are a couple of books about buying a house in Morocco- obtainable through Amazon, that describe the legal aspects of syndiques.

    If the syndique wished, it could be organised by announcing an 'official' meeting but telling everyone that it is just a shadow, so no one will turn up. Thus the next one, to which everyone can be warned in advance to turn up for will be legal, however many attend. Otherwise with uncertainty as to whether 50% will attend no one will know whether to attend the first meeting or not.

    We are purchasing in front line and would like an update on habitation licences(have heard conflicting stories)have any been granted.Will there be any problem getting snagging done after final payment is made.Does anyone know how much the comunity fees are for the front line.

  5. I found out that (through a third party) there is a meeting called for this Saturday to elect a syndiq to run the Sania Plage complex.

    Does anyone else know about this?

  6. If this is the case with regard to electing a syndiq to run the Complex surely we the owners should be notified to allow us (if we choose to)to be present and to cast our vote. We certainly have not had any notificiation of this at all.

    Yes the Syndique meeting went ahead as planned last Sunday.
    Estimate that there were 50 - 60 owners present..
    It was a lively meeting, and a vote was taken on adopting rules for the site, which was passed. Also 9 people volunteered to form the committee and were voted in.

  14. Have added a photo taken at the owners meeting, which took place on Sunday 24th July. Helen took some notes at the meeting, and will update here when she gets the chance.
    Incidentally - my invite to the meeting was posted to my home address and was at home when I got back to the UK! I had also received an email notification that someone had kindly forwarded to me (as my email address was incorrect on the e-mail invite). I would expect that an annual AGM will take place each year during the 'King's Month' holiday when most owners are holidaying at Sania Plage.

    At Alkudia there was an AGM, which did not have 50% owners. However, they still elected a syndic. The Non moroccan residents were not even informed of the meeting! Do you know if any of the Alkudia syndic are also part of any other syndic? It all seems very suspicious. Perhaps Hatim knows something?

    Hopefully all of you have newsletter from the Syndic, if you have not then I would suggest that you email the syndic at saniaplage@gmail.com as it has details of the ground rent for this year

    From my perspective I believe the syndic has made good start, i.e. they are commuminating with us and they indetified some of problems on site whihc needs to resolved plus looking to put in place good goverance. Also it good see their breakdown of the nationaties of the owners and number of unsold properties.

Having just returned from Sania I am pleased to say that members of the syndique came to visit us to advise us of what they were to discuss at their monthly meeting and to update us on other matters. We were very pleased with the maintenance of the grounds and the cleaning of the swimming pool (other is still being repaired) and the work on it looks good.

    The agenda was to cover: -
    cleaning of the beach
    electric gates at the complex entrance
    Fencing of some kind on the roadside and planting something like ivy for coverage
    A cordened off area in the sea in order to make it safe for swimming
    The road which is falling away on the hotel side of the complex to be shored up. (This work had commenced whilst we were there)

    Will update the discussion area at a later date but all in all at this moment in time it is all looking very very promising!!

  21. Just to confirm everything you have said Steve and Pat - we visited the last week of October.
    The pool had been repaired and was being re-filled. Work was happening at the hotel site also.
    The tennis court looks almost finished, but generally the site has never looked better, with good maintenace of the gardens.
    The syndque people are so nice and helpful, your help was much appreciated Kaoutar and Mr Abdelkader!!

    I am Abdel the general secretary of the syndic Sania plage.
    Among the reasons that led me to leave my responsibility as a supervisor are:
    - The decision to fill the pool and its operation has been repeatedly refused.
    - The Secretary is making decisions without consulting the supervisor, and enjoying her presence in the office for private business.
    - I am considered responsible for any delay or default work without considering the positive.

    latest news: (Trustee's meeting of 19.5.2012)
    Work:
    Pool 1: will be ready in a week
    Pool 2: nothing new.

    Toilets and showers:
    its will function in 1 or 2 weeks

    Gate and fence of the facade:
    Work is stopped by the authorities.

    The security company has taken on responsibility for future work.

    I agree with Paul that this is not good news. Just when things seemed to be happening . . . but I have some sympathy for your decision. I know from our encounters that you have had a difficult time and many problems to deal with.
    I think you have done a marvelous job, thank you for that!
    I'm slightly concerned though, that a security company takes responsibility for (building) work?

  28. Hello, This is a note to "Anonymous" and anybody else about Alcudia Smir Complex. Many issues with the current Syndic. I have asked about meetings. Apparently one has been called for 17 July 2012 finally. I will take note about Sania Plage comments re the 50% quorum remarks. Of course nothing sent out yet. Good job I can badger them in French!

    Notes from the syndicate meeting July 2012 from Hatim
    Hi,
    I went yesterday to the meeting of syndicate and it was really stressful 4 hours meeting. Abdel has resigned from the syndicate . he was not happy to deal with other members and he found out that the lady KAWTAR working as secretary has a business interest to be there. Syndic is a no profit organization but he feels that there is some interest of some members to be there and they hire that lady to do business under the table of syndic. We will see in the future if syndic will start doing business using syndic which is illegal.

    1. The Big issue we found-out in the meeting and most of talking was about : the relationship between the developer and syndic members. We found that there is no collaboration between both and we really need a good collaboration as the developer still have many things to accomplish in the complex .The developer still own many apartments in the complex. Need a lot of communication and good negotiation which they were not able to success to accomplish.

    One of big Syndic’s error is that they put apartment number of each apartment on the parking lot for each apartment, which upset the developer. The developer has not sold yet all commercials and all those commercial will not have a parking lot. They are not allowed to do so as will create more problems in the complex and that is not in our favor .

    2. we agree on syndicate fee to no base on meter square any more but on 2 amount small apartments 5000MAD per year and big apartments 10 000 MAD per year.

    3. Financial report was not prepared at the meeting and I asked to be available before we can vote on it. they print it and they give it to us. Financial report show that:

    A total Syndic fee income is 1 390 000 MAD

    Expenses: 889638,99 MAD

    Balance 500 361 MAD

    Our voice was heard at the meeting and I focused on hygiene and security.

    AS WE KNOW NOT ALL THE MEMBERS OF SANIA ARE LIVING THERE.SO THAT WE CAN FIND A MEMBER OR TWO WHO ARE TRYING TO SOLVE PROBLEMS .WHAT EVERY SYNDICATE NEED IS A GOOD MANAGER.WHO KNOW HOW TO MAKE THINHS BETTER AND SOLVE PROBLEMES AT ANY TIME .
    THE GOOD MANAGER MUST KNOW THESE THINGS /
    +LANGUAGES/ENGLISH/FRENCH/SPANISH AND ARABIC OF COURSE.IN ORDER TO COMUNICATE WITH EVERY OWNER .
    +MANAGER MUST KNOW HOW TO CONTROL EMPLOYES/THEIR PLACES/THEIR RESÖNSABILITE/...

Unfortunately we shall miss the meeting as we have had to postpone our visit until the end of July. Perhaps we should ask Hatim to ensure all owners are informed well in advance of any meetings, to at least give us a chance to attend....posted by Steve and Jan but deleted in error by me! Sorry
